Feds on Track to Begin Equal Employment Audits
Carlton Fields labor and employment attorney Rae Vann was quoted in a Construction Dive article titled, “Feds on Track to Begin Equal Employment Audits,” about the approval of two scheduling letters for construction companies with federal contracts.
The Office of Federal Contract Compliance (OFCCP) is set to release schedule letters requiring contractors to provide certain records, reports, and requests, as well as affirmative action plans, to prove that they are in compliance with federal equal employment opportunity law.
Vann cautions that though there is not a specific timeline for sending the schedule letters, contractors shouldn’t expect the coronavirus crisis to excuse or extend their response time.
"The OFCCP has been very deliberate in letting the contracting community know that the agency is still open for business," Vann said.
Vann suggests federal construction contractors conduct a comprehensive self-analysis to determine if they have the required documents, and, if so, where the documents are stored, so they are able to render a timely response and receive a favorable determination from the OFCCP.
