Insurance Government Consultant Beth Vecchioli Quoted in Law360, Discusses Assignment of Benefits H.B. 7065

The Florida House of Representatives passed a bill on Thursday, April 11 that addresses concerns over increasing litigation and abuse resulting from property owners' assignment of insurance benefits to contractors. According to Law360, this has been blamed for driving up consumer premiums in the state. Most significantly, a key change in the house bill (H.B. 7065), which passed 96-20, is the replacement of a one-way attorney fees provision in favor of assignees.
Vecchioli commented, “If you decided to assign your rights, you're not just assigning your benefits but also the duties. The intent [of this bill] is to discourage litigation if these things can be settled outside of litigation.”
