Fortnite Gamer’s Suit Puts Pressure on Esports Contracts

Carlton Fields attorneys Steven Blickensderfer and Nicholas A. Brown, co-chairs of the firm’s Esports and Electronic Gaming practice, spoke to Law360 about the potential implications of a contract lawsuit filed by professional gamer Turner Tenney, known as Tfue, against his esports team.
 
“If [Tenney] prevails, it would be a very significant piece of precedent because it would take a lot of existing regulations that have not applied to esports and it would put them over that,” Brown told Law360.
 
The esports industry largely faces traditional legal challenges, but the solutions must take into account the nuances of a world few lawyers fully understand. Blickensderfer added, “As this industry grows at this meteoric rate, you are going to see people kicking the tires on contracts that they have been using, and players demanding more, and less-onerous provisions.”
