Fla. Hospital Can Verify Records Request In Med Mal Suit

A Law360 article, “Fla. Hospital Can Verify Records Request in Med Mal Suit,” highlighted a recent Florida appeals court ruling confirming that a hospital, Shands Jacksonville Medical Center Inc., can seek verification of individuals asking for medical records. Carlton Fields attorneys Christine Davis Graves and James Parker-Flynn represented Shands.
 
The case, brought by a deceased defendant’s representatives, was overturned from lower court when the First District Court of Appeals argued that Shands had the right to establish the legal status of a person requesting patient medical records without forfeiting the right to demand a pre-suit written medical complaint.
 
The ruling upholds the state’s protections for the privacy of confidential medical information.
